Terms of Service

1. Eligibility

You must be at least 13 years old to use Stepio. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information (email and username)
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Health Data

Stepio accesses step count data from Apple HealthKit (iOS) and Google Health Connect (Android). By granting permission, you acknowledge that:

• Health data is stored locally on your device
• Health data is used solely to display your activity and enable leaderboard features
• We do not transmit health data to our servers (this may change with prior notice and consent)
• You can revoke health data access at any time through your device settings

⚠️ Stepio is not a medical application. Do not use step data for medical decisions. Consult a healthcare professional for health-related concerns.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Create an account using false or misleading information
• Impersonate another person or entity
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Use the App to transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Create offensive, inappropriate, or misleading usernames or group names

We reserve the right to remove content and suspend accounts that violate these guidelines.

5. User-Generated Content

You may create group names and upload profile avatars ("User Content"). By submitting User Content, you:

• Retain ownership of your content
• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content within the App
• Represent that you have the right to submit such content
• Agree not to submit content that is illegal, offensive, defamatory, or infringes on others' rights

We may remove User Content that violates these Terms without notice.

6. Social Features & Leaderboards

Stepio includes social features that allow you to:

• Add friends and join groups
• View and be viewed on step count leaderboards
• Share your username, avatar, and step counts with other users

By using these features, you consent to your information being visible to other users as described in our Privacy Policy.

7. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by SW Software LLC and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract the source code
• Use our trademarks or branding without permission

8. Future Features

We may introduce additional features including:

• In-app purchases and subscriptions
• Advertisements
• Push notifications
• Email communications

We will update these Terms and/or our Privacy Policy before introducing features that materially affect your use of the App.

9. Fees and Payments

Stepio is currently free to use. If we introduce paid features:

• Pricing will be clearly displayed before purchase
• Payments will be processed through Apple App Store or Google Play Store
• Refunds are subject to the respective store's policies

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy or reliability of step count data
• Uninterrupted or error-free operation
• Fitness for a particular purpose

Step count data is provided by Apple HealthKit and Google Health Connect. We are not responsible for the accuracy of this data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SW SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data
• Loss of profits
• Personal injury or health issues

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless SW Software LLC from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

You may stop using the App at any time and delete your account through the Profile section.

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the App
• Is otherwise inappropriate

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice in the App or updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
